Environmental Protection Agency
The environmental protection Agency (EPA) is the Federal Authority which regulates waste nationwide. In, Florida, the state authority that supervises the EPA's regulation is the Florida Department of Environmental Protection (FDEP). Applicable statues in Florida includes Florida Statues (FS) Chapters 381 and Chapter 403, Florida Administrative Codes (FAC) Chapter 17-712 and Chapter 10D-104, Rules of the Department of Environmental Protection (DEP), and Rules of Department of Health (DOH). DOH regulates the identification, packaging, storage and treatment of biohazard waste at the generating facility.

Florida Department of Environmental Protection
A fine $2,500 per day, per violation, is authorized by law and may be levied against violations during an enforcement action The improper handling and/or disposal of medical waste can pose serious health risk to the generator and everyone in the community. Medical waste sharps are objects such as needles syringes, lancets and other sharp objects used for medical purposes. EPA, OSHA, and the State of Florida regulations require that medical waste be properly handled, treated, and disposed of by a licensed Medical Waste Disposal Company.

FLORIDA DEPARTMENT OF HEALTH
381.0098 Biomedical waste. The Department of Health shall regulate the packaging, transport, storage, and treatment of biomedical waste. The Department of Environmental Protection shall regulate onsite and offsite incineration and disposal of biomedical waste. Consistent with the foregoing, the Department of Health shall have the exclusive authority to establish treatment efficacy standards for biomedical waste and the Department of Environmental Protection shall have the exclusive authority to establish statewide standards relating to environmental impacts, if any, of treatment and disposal including, but not limited to, water discharges and air emissions. An interagency agreement between the Department of Environmental Protection and the Department of Health shall be developed to ensure maximum efficiency in coordinating, administering, and regulating biomedical wastes.
Biomedical waste” means any solid or liquid waste which may present a threat of infection to humans. The term includes, but is not limited to, nonliquid human tissue and body parts; laboratory and veterinary waste which contains human-disease-causing agents; discarded disposable sharps; human blood, blood products, and body fluids; and other materials which in the opinion of the department represent a significant risk of infection to persons outside the generating facility. The term does not include human remains that are disposed of by persons licensed under chapter 497.
Fact
Every year, biomedical waste (potentially infectious materials such as needles, blood products, etc.) is disposed of improperly, placing sanitary workers as well as general public at risk for contracting dangerous diseases. Needles and other medical waste may be contaminated with Hepatitis, HIV, AIDS, and other infectious diseases that can cause severe illness or even death. The Florida Legislature has passed laws to regulate the healthcare industry and any business that has needles to discard or produce biomedical waste.
